This Privacy Policy describes how Retell AI, Inc ("Retell AI," "we," "us," or,” "our") collects, uses, and discloses personal information when you visit  www.retellai.com, interact with our marketing campaigns, communicate with us, engage withy us over social media, attend events that we host or sponsor, or use our voice AI Agent Creation platform and related services (collectively, the "Services"), or otherwise interact with us. Retell AI collects and uses personal information in two capacities: (1) for our own business purposes, including operating our website, marketing, sales, and business administration; and (2) as a service provider processing data on behalf of our customers in connection with their use of the Services. Where we process data on behalf of a customer, we will enter into a data processing addendum or similar agreement that governs our processing of personal information on behalf of a customer. By using the Services, you consent to the data practices described in this Privacy Policy.

We do not knowingly collect information from children under the age of 16. If we determine that we have collected information from a child under the age of 16, we will delete that information. 

PERSONAL INFORMATION THAT WE COLLECT

  1. Information You Provide to Us

In order to better provide you with products and services offered, Retell AI may ask you to provide certain personally identifiable information that can be used to contact or identify you. The kinds of personal information you may provide to us includes, but is not limited to:

  • Email address
  • First name and last name
  • Government ID, business registration, physical address, tax ID, and authorized representative verification
  • Phone number
  • Address, State, Province, ZIP/Postal code, City
  • Company or organization name
  • Job title
  • Payment and billing information
  • Customer account information
  • Customer content, feedback, surveys or questionnaires
  • Customer and prospective customer emails and communications (including recorded calls and AI generated transcripts of customer or prospective customer communications) 

We collect this information when you provide it to us (for example, when you register to use the Service, contact us, or fill out forms).

  1. AI Communications (Voice and Text Messaging); Call Recording Disclosures

When our customers purchase our Services, we may collect the following types of data ("Communications Data") from our Customers and their end users, including but not limited to:

Our Services may record, transcribe, or otherwise process voice interactions between our customers' AI agents and their end users. Retell AI may also record or monitor calls for quality assurance, safety, security, and service improvement purposes. Where Retell AI initiates recording for its own purposes, we will provide notice as required by applicable law.

  • Audio recordings of voice interactions
  • Call transcripts and conversation summaries
  • Call and text message metadata (e.g., date, time, duration, phone number, delivery status)
  • Telephony data (e.g., carrier information, connection details, routing information)
  • Interaction logs (e.g., agent responses, user inputs, and conversation flow)
  • Content or data transmitted through the Services by you or your end users
  • Source and destination 
  • location of the device generated in the context of delivering the communication
  • Error data and traffic records
  • Device IP address and device information
  1. Automatically Collected Information

Additionally, whether you visit our Service, receive communications from our customers, we automatically collect certain kinds of personal information via cookies or other tracking technologies. The type of information that we automatically collect via tracking technologies includes: 

  • IP address and general location information (e.g., city or region)
  • Unique identifiers
  • Browser type and version, time zone setting, and language preferences
  • Device information (e.g., device type, operating system, unique device identifiers, manufacturer, model, diagnostic data and screen resolution)
  • Pages visited, features used, products viewed or searched for, and the date, time, and duration of your activity
  • Referring and exit URLs, clickstream data, and page interaction information (e.g., scrolling, clicks, and mouse movements)
  • API request logs and server log data
  • Page response times, download errors, and other diagnostic information

We collect this information through cookies, web beacons, pixels, server logs, and similar tracking technologies. This information is collected whether you access our website, or the Services via a desktop browser, mobile device, or API integration. We also collect this information when you open emails from us. We do not collect precise geolocation information.

Examples of cookies we use:

  • Session Cookies: These are temporary cookies that expire when you close your browser. We use session cookies to maintain your session state, authenticate your identity, and enable core functionality as you navigate the Service.
  • Preference Cookies: These cookies allow our Service to remember choices you make (such as language, region, or display settings) and provide a more personalized experience. They may also be used to remember changes you have made to customizable parts of the Service.
  • Security Cookies: These cookies help detect and prevent security risks, such as unauthorized access, fraud, and abuse. They support authentication, protect against cross-site request forgery, and help us maintain the integrity of our Service.
  • Advertising and Social Media Cookies: These cookies are placed by us or third-party advertising and social media partners to deliver advertisements that may be relevant to you and your interests, limit the number of times you see an advertisement, and measure the effectiveness of advertising campaigns. They may also enable social media features such as content sharing and social login.
  1. Information we Receive from Third Parties

We may receive personal information about you from third-party sources and combine it with information we already hold. The types of third-party sources and information we may receive include, but are not limited to:

  • Telecommunications providers and carriers: carrier name and type, phone number validation and portability data, SIM status, routing information, call delivery status, and error or traffic records.
  • Communications platform providers (e.g., Twilio): call and message metadata, delivery and connection status, source and destination information, and other data generated in the course of routing and delivering communications through the Services.
  • Analytics and advertising partners: information about your interactions with our advertisements or marketing campaigns on third-party platforms, including conversion events, click and impression data, and advertising identifiers.
  • Social media platforms: information you make available through your social media accounts when you interact with our pages or content, or use social login features, in accordance with your privacy settings on those platforms.
  • Business intelligence data providers: professional and company information such as your employer, job title, industry, company size, and business contact details, which we may use for sales, marketing, and lead generation purposes.
  • Payment processors: billing verification data and transaction status information related to your use of paid Services.

HOW WE USE THE PERSONAL INFORMATION THAT WE COLLECT

We use the personal information that we collected or receive:

  • to create and manage customer accounts, and to provide, support, maintain, improve and develop our Services;
  • to verify your identity, authenticate your account, and prevent unauthorized access;
  • to route and deliver voice, text, and other communications through the Services on behalf of our customers;
  • to train the artificial intelligence models that support our Services or that support our business and administrative functions;
  • gather analysis or valuable information so that we can improve our Service;
  • to monitor the usage of our Service;
  • to allow you to use the interactive features of our website, emails, social media profiles or our Services;
  • to administer our business, including for account administration, accounting, auditing and compliance, business analytics, filing taxes, finance, forecasting, consolidated management and reporting, product strategy and revenue planning.
  • to detect, prevent, and address technical issues, security incidents, fraud, abuse, and other harmful activity;
  • improve, train, and enhance our AI models and related technologies;
  • comply with applicable laws, regulations, and legal processes, and respond to lawful requests from public authorities;
  • aggregate, anonymize, or de-identify personal information for research, analytics, benchmarking, and reporting purposes;
  • detect, prevent, and address violations of our terms of use, or other abuse or misuse of our website or Services;
  • carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • to comply with legal and regulatory obligations, telecommunication service provider requirements and communications industry codes of practice, where applicable;
  • provide you with notices about your account and/or subscription, including expiration and renewal notices, email-instructions, etc.;
  • send marketing communications, or to provide you with news, special offers, and general information about other goods, services, and events which we offer that are similar to those that you have already purchased or inquired about unless you have opted not to receive such information;
  • deploy automatic tracking technologies, including cookies and other tracking technologies in accordance with your online settings;
  • understand how visitors navigate our websites, respond to communications, and to track and optimize the performance of our Services and advertising activities;
  • manage participation in events, surveys or other communications;
  • in any other way we may describe when you provide the information;
  • fulfill the purpose for which you provide it;
  • for any other purpose with your consent.

HOW WE DISCLOSE OR SHARE PERSONAL INFORMATION

We may disclose personal information to third parties as described in this Section. 

  • Service Providers and Subprocessors: We engage third-party service providers to perform functions on our behalf, such as hosting, analytics, payment processing, customer support, identity verification, Know-Your-Customer (KYC) compliance, and communications delivery. These providers are contractually obligated to use personal information only as necessary to provide services to us and to maintain appropriate confidentiality and security measures.   • Telecommunications Providers and Communications Platforms: To route and deliver voice calls, text messages, and other communications through the Services, we disclose Communications Data and related metadata to telecommunications carriers, aggregators, and communications platform providers (e.g., Twilio, telecommunications carriers). These providers may process certain data as independent controllers for their own purposes, including billing and fraud prevention, in accordance with their own privacy policies and applicable telecommunications regulations.
  • Affiliates and Subsidiaries: We may share personal information with our subsidiaries and affiliates for purposes consistent with this Privacy Policy, including for business operations, service delivery, and internal reporting.
  • Business Transfers: In connection with a merger, acquisition, reorganization, asset sale, or similar transaction, personal information may be among the assets transferred or disclosed during due diligence. If such a transaction occurs, we will use reasonable efforts to ensure that the acquiring entity honors the commitments made in this Privacy Policy with respect to your personal information. Where required by law, we will notify you prior to such a transfer.
  • Legal Compliance and Law Enforcement. We may disclose personal information if required to do so by law or if we reasonably believe that disclosure is necessary to: (a) comply with applicable law, regulation, legal process, or a valid governmental request; (b) enforce our agreements and policies, including our Terms of Service; (c) respond to claims that content transmitted through the Services violates the rights of third parties; (d) cooperate with regulatory authorities, law enforcement, or judicial proceedings; or (e) fulfill Know-Your-Customer (KYC), identity verification, or other regulatory obligations applicable to telecommunications services.
  • Safety and Rights Protection:  We may disclose personal information when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Retell AI, our customers, their end users, or the public, including to detect, prevent, or address fraud, security incidents, or technical issues.
  • At Customer Direction: Where we process personal information as a service provider on behalf of a customer, we may disclose that information in accordance with the customer's instructions and the terms of our agreement with that customer, including the applicable Data Processing Addendum.
  • Aggregated or De-identified Data: We may share aggregated, anonymized, or de-identified data with third parties for research, analytics, benchmarking, industry reporting, or other purposes. This data does not identify you personally, and we do not attempt to re-identify such data.
  • With Your Consent: We may disclose your personal information for any other purpose with your prior consent.

RETENTION OF DATA

Generally, we retain personal information only for as long as is necessary for the purposes set out in this Privacy Policy. Usage data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods. We determine retention periods based on the nature of the data, the purposes for which it is processed, and legal requirements. Where feasible, we anonymize or aggregate data instead of retaining it in a form that identifies you. When data is no longer needed, it will be securely deleted or anonymized. Where we act as a service provider to a customer, our customer determines the retention period. 

INTERNATIONAL TRANSFER OF DATA

Retell AI is based in the United States, and the personal information we collect is primarily stored and processed in the United States. If you are located outside the United States, please be aware that personal information you provide to us, or that we collect through your use of the Services, will be transferred to and processed in the United States and potentially other jurisdictions where data protection laws may differ from those in your country or region.

Where we transfer personal information from the European Economic Area (EEA), the United Kingdom, or Switzerland to countries that have not been deemed to provide an adequate level of data protection, we implement appropriate safeguards as required by applicable law. These safeguards may include the European Commission's Standard Contractual Clauses (SCCs), the UK International Data Transfer Agreement (IDTA), or other approved transfer mechanisms. You may request a copy of the applicable transfer safeguards by contacting us at support@retellai.com. Our telecommunications and communications platform providers (e.g., Twilio) may also transfer data internationally in connection with routing and delivering communications; such transfers are subject to those providers' own transfer mechanisms and privacy policies.

SECURITY OF DATA

While recognizing the importance of securing your data, we understand that no method of transmission over the Internet or method of electronic storage is 100% secure. Nevertheless, we will strive to use commercially acceptable means to protect personal information, but we cannot guarantee its absolute security.

YOUR DATA PROTECTION RIGHTS UNDER VARIOUS PRIVACY LAWS

  1. General Data Protection Regulation (GDPR)

If you are a resident of the European Union (EU) and European Economic Area (EEA), you may have certain data protection rights under the GDPR. In certain circumstances, you may have the following data protection rights:  

  • the right to access, update or to delete your personal information;
  • the right to rectify your personal information if that information is inaccurate or incomplete;
  • the right to object to the processing of your personal information;
  • the right to request that the processing of sensitive personal information is restricted, where applicable;
  • the right to request and be provided with a copy of your personal information in a structured, machine-readable and commonly used format;
  • the right to withdraw consent at any time where we rely on your consent as our lawful basis in processing any of your personal information;

  1. U.S. Data Privacy Laws

If you are a resident of a U.S. state with an applicable consumer privacy law, you may have certain rights with respect to your personal information to the extent such laws apply to us. This section describes the categories of personal information we collect, how we use and disclose it, and the rights available to you under applicable state law, if applicable.

  • Categories of Personal Information Collected. In the preceding twelve (12) months, we have collected the following categories of personal information: identifiers (such as name, email address, phone number, and IP address); commercial information (such as purchase history and account activity); internet or other electronic network activity information (such as browsing history, search history, and interaction data); geolocation data (general location based on IP address); professional or employment-related information (such as company name and job title); audio, electronic, and visual information (such as call recordings and transcripts collected through the Services); and inferences drawn from the above categories.
  • Categories of Personal Information Disclosed for a Business Purpose. We disclose personal information to service providers, telecommunications providers, and other third parties as described in the "How we Disclose or Share Personal Information" section of this Privacy Policy for business purposes such as providing and improving the Services, processing payments, analytics, security, and legal compliance.
  • Sale and Sharing of Personal Information. We do not sell your personal information for monetary consideration. However, we may share personal information with advertising and analytics partners through cookies and similar tracking technologies for purposes of cross-context behavioral advertising, which may be considered a sale of information in some states. You may opt out of such sharing by adjusting your cookie preferences on our website.
  • Sensitive Personal Information. We do not collect sensitive personal information for purposes beyond those permitted under applicable state law. To the extent we ever process sensitive personal information, we do so only as necessary to provide the Services or as otherwise permitted by law.

Your Rights. Depending on where you reside, you may have the right to:

  • Know what personal information we collect, use, disclose, and sell or share about you;
  • Access and obtain a copy of your personal information in a portable format;
  • Delete your personal information, subject to certain exceptions;
  • Correct inaccurate personal information;
  • Opt out of the sale or sharing of your personal information for cross-context behavioral advertising;
  • Limit the use and disclosure of your sensitive personal information; and
  • Not be discriminated against for exercising any of these rights.
  1. Exercising Your Rights Under Applicable Data Privacy Law. 

To submit a request under U.S. privacy law or international privacy law (GDPR), please contact us at support@retellai.com or by mail at Retell AI, Inc, 540 Price Ave, Redwood city, CA, 94063. We will verify your identity before processing your request by matching identifying information you provide against what we have on file. You may also designate an authorized agent to make a request on your behalf, provided the agent can demonstrate valid written authority to act for you.

We will respond to verifiable consumer requests within 45 days of receipt, unless we are legally required to respond sooner. If we require additional time, we will inform you of the reason and the extension period (up to an additional 45 days). We will not charge a fee to process or respond to your request unless the request is manifestly unfounded or excessive.

If we decline to take action on your request, you may appeal that decision by contacting us at support@retellai.com with the subject line "Privacy Rights Appeal." If your appeal is denied, you may contact your state's attorney general or applicable regulatory authority.

Under the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the EU/EEA Member State of your habitual residence, place of work, or the place of the alleged infringement, if you consider that the processing of your personal data infringes the GDPR. If you are located in the United Kingdom, you may lodge a complaint with the Information Commissioner's Office at https://ico.org.uk/make-a-complaint/

  1. Lawful Bases. 

We process personal information on one or more of the following legal bases under Article 6 of the GDPR: (a) your consent, where you have given it (for example, for marketing communications or the use of non-essential cookies); (b) performance of a contract, where processing is necessary to provide the Services you have requested or to take steps at your request prior to entering into a contract; (c) legitimate interests, where processing is necessary for our legitimate business interests (such as improving and securing our Services, conducting analytics, preventing fraud, and direct marketing to existing customers) and those interests are not overridden by your data protection rights; and (d) compliance with a legal obligation, where we are required to process your data under applicable law.

  1. Automated Decision-Making

We use artificial intelligence and machine learning models to provide our Services, including to process voice and text communications, generate transcripts, and deliver conversational AI experiences. When acting as a service provider on behalf of our customers, the customer controls how AI outputs are used in connection with their end users. We do not use automated decision-making that produces legal effects or similarly significant effects on individuals without human involvement, unless required by a customer's specific configuration of the Services. YOUR CHOICES

You have several choices regarding your personal information, as described below.

  • Account Information and Deletion: You may update or correct your account information at any time by logging into your account or by contacting us at support@retellai.com. If you wish to delete your account, you may do so through your account settings or by contacting us. When you delete your account, we will delete or de-identify your personal information within a reasonable period, except where we are required to retain certain information for legal, regulatory, or legitimate business purposes (such as billing records, fraud prevention, or compliance with telecommunications regulations). Deletion of your account may result in the loss of access to the Services and any data associated with your account.

  • Cookie Preferences: You can manage your cookie preferences at any time through the cookie preference tool available on our website. You can also configure your browser to refuse all cookies or to alert you when a cookie is being sent. If you disable cookies, some features of the Services may not function properly. We honor Global Privacy Control (GPC) and Do Not Track (DNT) signals where required by applicable law. For more information about the cookies we use, see the "Automatically Collected Information" section of this Privacy Policy.

  • Communication Preferences: You may opt out of receiving marketing or promotional emails from us by clicking the "unsubscribe" link in any marketing email you receive. Even if you opt out of marketing communications, we will continue to send you transactional and service-related communications (such as account notifications, security alerts, billing information, and updates to our Terms of Service or this Privacy Policy). You cannot opt out of these service-related communications while you maintain an account with us.

  • Opt Out of Sale or Sharing: As described in the "U.S. Data Privacy Laws" section, you may opt out of the sharing of your personal information for cross-context behavioral advertising by adjusting your cookie preferences on our website or by enabling a recognized opt-out signal such as Global Privacy Control (GPC). 

  • Our Policy on “Do Not Track” Signals:  When a "Do Not Track" browser feature is enabled, we respect the signals and don't track, install cookies, or employ advertising. You can tell websites that you do not want to be tracked by using the Do Not Track option on your web browser. Go to your browser's Preferences or Settings page to enable or disable Do Not Track.

Please be aware that requesting that we remove or cease selling your data may have an effect on how you interact with us and may prevent you from taking advantage of certain services or certain programs that depend on the use of your personal information.

CHANGES TO THIS PRIVACY POLICY

Retell AI reserves the right to change this Privacy Policy from time to time. We will notify you about changes by placing a prominent notice on our website. Your continued use of the Services, or interaction with us after the posting effective date will constitute your agreement to abide and be bound by that Policy.
